美国租约 Lease Agreement 审阅指南:20 个必读关键条款

在美国签署 Lease Agreement(租赁协议)是租房过程最关键的一步。这份文件一旦签署,就成为有法律约束力的契约,双方必须遵守——即使后来不满意也很难反悔。许多留学生因为没仔细阅读 Lease 而陷入纠纷:扣押金、被追债、影响信用记录。本文详细解读 Lease 的每个关键条款。

为什么必须认真审阅 Lease?

根据美国租赁权益中心(AREC)的数据:

关键是——房东掌握信息优势。他们的 Lease 通常是预写模板,倾向于保护房东权益。作为租客,你有权要求修改、澄清或拒绝某些条款。最坏的情况是房东拒绝,但至少你做了知情决策。

1. Parties(当事人)

2. Property Description(物业描述)

检查项:你看到的房源照片和现场环境是否与描述一致?

3. Term(租赁期限) 标准示例:

The Term of this Lease shall commence on May 1, 2026 
and end on April 30, 2027, for a total of 12 months.

4. Rent Amount(房租金额)与支付方式

Monthly Rent: $1,500
Payment Due: On or before the 1st of each month

冰箱坏取决于房东提供还是租客自带”Refrigerator provided: Landlord responsibility”

"Landlord shall pay for all utilities including electricity, 
water, gas, and internet. Tenant shall have no utility costs."

"Tenant shall pay for electricity and internet ($50/month estimated).
Landlord shall pay for water and gas."

版本 C(租客全部承担,但房东有责任):
"Tenant shall set up and pay for all utilities.
Landlord warrants that utilities are available at property."

务必澄清:

11. Early Termination(提前终止)

这是最容易产生经济纠纷的条款。

"If tenant terminates lease before end date,
tenant shall pay an Early Termination Fee of 2 months' rent."

示例 2(相对公平):

"Tenant may terminate with 60 days' written notice
and pay a Early Termination Fee of $300(or 1 month's rent, whichever is less).
Landlord shall make reasonable efforts to re-lease the unit."

示例 3(最佳):

"Tenant may terminate with 60 days' notice.
Early Termination Fee shall be $300.
Landlord shall credit rent from replacement tenant against this fee."

12. Subletting & Lease Assignment(转租与接权转让)

示例 1(禁止转租):

"Subletting is strictly prohibited.
Tenant may not sublet any portion of the apartment."

示例 2(允许转租):

"Tenant may sublet with landlord's prior written consent,
which shall not be unreasonably withheld."

关键区别:

"Tenant may sublet room/apartment with landlord's written consent.
Landlord shall not unreasonably withhold consent.
Tenant remains liable for rent if sub-tenant fails to pay.
Sub-tenant must sign Sublease Agreement with identical terms."

第 16-20 章:其他关键条款

13. 行为与违反条款(Conduct & Violations)

通常列举禁止事项:

问题:哪些违反条款导致驱逐?哪些仅是警告?Lease 应该明确等级制。

14. 进入权(Right of Entry)

示例:

"Landlord may enter property to inspect, make repairs, or show unit.
Landlord shall provide 24 hours' written notice,
except in case of emergency."

保护隐私的条款:

✅ "Entry is limited to normal business hours (8am-5pm, Mon-Fri)"
✅ "Landlord may not enter more than once per month without cause"
❌ "Landlord may enter anytime for any reason" → 侵犯隐私

15. 续租与自动续约(Renewal & Auto-Renewal)

示例:

"Lease shall terminate on April 30, 2027.
No automatic renewal.
Either party must notify 60 days in advance if they intend to renew."

或(自动续租):

"Lease shall automatically renew for 12-month terms
unless either party provides 90 days' written notice of non-renewal."

如果是自动续租条款,务必在日历上标注提醒,否则会被锁定另一年。

16. 驱逐程序与违约处理(Eviction & Default)

标准程序:

1. 房东发送书面"Cure or Quit"通知(通常 3-5 天改正或搬出)
2. 如租客未遵守,房东提交驱逐诉讼
3. 法庭审讯(租客可出庭辩护)
4. 法院发布驱逐令
5. 警长强制执行,搬出生效

Lease 应明确什么情况导致驱逐:

17. 法律管辖与纠纷解决(Jurisdiction & Dispute Resolution)

示例:

"This Lease shall be governed by the laws of [State].
Any dispute shall be resolved in [County] Small Claims Court."

或(更复杂):
"Disputes shall first go to Mediation.
If unresolved, arbitration in accordance with AAA rules."

关键:确保你理解纠纷的解决地点和方式。某些 Lease 要求在离你很远的地方诉讼(对你不利)。

18. 搬出条件(Move-out Requirements)

示例:

"Upon lease termination, tenant shall:
1. Remove all personal belongings
2. Clean apartment to original condition(normal wear and tear excepted)
3. Provide forwarding address for deposit return
4. Surrender all keys and access cards
5. Return unit within 24 hours of lease end date"

关键问题:

19. Move-in Inspection & Documentation

虽然不总是在 Lease 里,但应要求:

"Landlord and tenant shall jointly conduct move-in inspection
within 3 days of move-in.
Condition report shall be signed by both parties.
Any pre-existing damage must be documented
to protect tenant's security deposit."

20. 附加费与隐藏费用(Additional Fees)

务必列出所有费用,不应有”隐藏费”:

常见费用是否合理备注
申请费(Application Fee)$25-50✅ 合理应在签约前支付,非租金的一部分
背景检查费(Background Check)$25-50✅ 合理通常由租客承担
宠物费(Pet Fee)$50/月✅ 合理若允许宠物

红旗:Lease 底部有”其他费用,双方协议确定”之类的模糊条款 → 要求明确列出每项费用。

国际学生必看的额外条款

Co-signer 条款(如需担保人):

"Guarantor agrees to assume all obligations under this Lease
should tenant fail to pay or comply.
Guarantor's liability continues even if tenant is released."

确保:

国际学生特殊声明

"Tenant certifies he/she is on valid student visa (F-1/J-1) 
and will maintain visa status throughout lease term.
Tenant is responsible for maintaining compliance with visa requirements."

如果签署这条,务必保持你的国际学生身份有效(不能 Drop Out 或 Work Off-Campus)。

如何修改或协商 Lease?

方式 1:修改条款

用笔在条款旁边修改,双方各签名确认修改
例如:
原:Late Fee: $100
改为:Late Fee: $50
     [房东签名] [租客签名]

方式 2:Addendum(附加协议) 在签署 Lease 之前,要求房东签署补充协议,覆盖你要修改的条款:

ADDENDUM TO LEASE

1. Early Termination Fee shall be $300, not 2 months' rent.
2. Subletting is permitted with landlord's consent.
3. [Add your terms here]

Both parties sign below to confirm these amendments.

方式 3:逐项协商 不要一次性拒绝整份 Lease。列出 3-5 个关键条款,协商修改。房东更可能接受有理由、合理的修改请求。

签署后的重要步骤

  1. 获取签署副本:拍照或扫描,保存到云端(Google Drive、Dropbox)
  2. 拍照记录:Move-in 前后拍摄每个房间的照片和视频(时间戳)
  3. 建立沟通记录:与房东的所有重要沟通用邮件而非口头(有记录)
  4. 保存所有文件:Application、Background Check、Lease、Receipts(押金收据)
